Terms of Service

1. Agreement

These Terms of Service ("Terms") are a binding agreement between you and AndresAI ("AndresAI", "we", "us"), operated from Manitoba, Canada. By creating an account or using andresai.ca, our apps, or any related service (the "Service"), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

If you use the Service on behalf of a business, you confirm you are authorized to accept these Terms for it.

2. Eligibility & accounts

You must be at least 13 years old, or 16 in the EU/EEA and UK, or the age of digital consent where you live, whichever is higher. Users under the age of majority need permission from a parent or guardian.

You are responsible for the information you give us, for keeping your login secure, and for everything done under your account. Tell us right away if you think your account was accessed without permission. One person may not create multiple accounts to get around plan limits.

3. The Service

AndresAI provides AI chat, image, video, music, voice, meeting transcription, photo and video editing, measurement and estimating tools, and related features. Some features rely on third-party AI providers and may change, be limited, or be removed. We may update the Service at any time and do not promise it will always be available or error-free.

4. AI output disclaimer

Content produced by AI ("Output") is generated automatically and can be inaccurate, incomplete, outdated, offensive, or similar to content created for others. Output is provided "as is" for information and creative purposes only.

Output is not professional advice. It is not legal, medical, financial, tax, engineering, architectural, safety, or other professional advice. Always verify important information and consult a qualified professional before acting on it. You are responsible for how you use Output.

5. Site Measurement & Estimator disclaimer

Measurements, camera and AR readings, areas, volumes, material quantities, costs, crew sizes, and timelines produced by the Site Measurement & Estimator or any other tool are approximations for preliminary planning only. They are not certified surveys, engineered drawings, stamped plans, building code reviews, or quotes.

Before building, ordering materials, or signing contracts, have measurements confirmed on site and plans reviewed by a licensed engineer, architect, surveyor, or contractor as required where you work. AndresAI is not responsible for losses from relying on these estimates.

6. Acceptable use

You agree not to use the Service to create, upload, or share: sexual or sexually explicit content of any kind; any content involving the sexual exploitation of minors (which we report to authorities); content that is illegal, defamatory, harassing, hateful, or threatening; content that encourages violence, self-harm, or terrorism; malware or spam; or deceptive deepfakes or impersonation of real people without their consent.

You also agree not to: infringe anyone's copyright, trademark, privacy, or publicity rights; break any law, including export control and sanctions laws; scrape, resell, or copy the Service; reverse engineer it or try to access our code, servers, or secret keys; get around usage limits or safety filters; or use Output to build a competing AI model.

We may remove content, block requests, and suspend or close accounts that break these rules, with or without notice.

7. Your content & ownership

You keep ownership of the prompts, files, recordings, and other content you provide ("Input"). Between you and AndresAI, and to the extent allowed by law, you own the Output created for you, including for commercial use. Some countries do not grant copyright to purely AI-generated works, and similar Output may be created for other users.

You give AndresAI a limited, worldwide license to store, process, and transmit your Input and Output only to run and improve the safety of the Service for you, including sending it to our AI and hosting providers. We do not use your content to train AI models.

You confirm you have the rights needed for any content you upload, including recordings of other people. Get consent before recording meetings or calls where the law requires it.

8. Our intellectual property

The AndresAI name, logo, website, apps, software, and design belong to AndresAI and its licensors and are protected by law. These Terms give you a personal, non-exclusive, non-transferable right to use the Service; they do not give you ownership of it.

If you send us feedback or ideas, we may use them freely without paying you.

9. Plans, payments & cancellation

Paid plans are billed in advance through our payment processor, Stripe, monthly or yearly as you choose. Prices are shown at checkout and may include applicable taxes. Plans renew automatically at the then-current price until you cancel.

You can cancel anytime from Settings → Manage Billing & Subscription. Cancellation stops the next renewal; you keep paid access until the end of the current period. Except where required by law, payments are non-refundable and unused allowances do not roll over. Where your local law gives you a right to cancel or a refund (for example, EU/UK consumer rules), those rights still apply.

Plan limits and features may change. We will give notice before a price increase affects your next renewal. Promotional codes, gifts, and bonus credits have no cash value. If a payment fails, we may move your account to the free plan.

10. Third-party services

The Service uses third parties such as AI model providers, Google sign-in, Stripe, and web search. Your use of those services may also be subject to their terms. We are not responsible for third-party services, websites, or search results linked from the Service.

11. Suspension & termination

You may stop using the Service and delete your account anytime in Settings. We may suspend or end your access if you break these Terms, if required by law, or to protect users or the Service. Sections that by their nature should survive (such as ownership, disclaimers, liability limits, and governing law) continue after termination.

12. Disclaimer of warranties

To the fullest extent permitted by law, the Service and all Output are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.

13. Limitation of liability

To the fullest extent permitted by law, AndresAI will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business, arising from your use of the Service or Output. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or CAD $50.

Some places do not allow certain limits, so some of these may not apply to you. Nothing in these Terms limits liability that cannot be limited by law, such as for fraud, gross negligence, or death or personal injury caused by negligence.

14. Indemnity

To the extent allowed by law, you agree to cover AndresAI's reasonable costs and losses from claims caused by your content, your misuse of the Service, or your breach of these Terms or the law.

15. Governing law & disputes

These Terms are governed by the laws of the Province of Manitoba and the federal laws of Canada that apply there, without regard to conflict-of-law rules. Disputes will be handled in the courts of Manitoba, Canada.

If you are a consumer, you keep the protection of the mandatory laws of the country where you live and may bring claims in your local courts where the law allows. Please contact us first so we can try to resolve any problem informally. To the extent permitted by law, claims must be brought individually, not as part of a class action.

16. Changes to these Terms

We may update these Terms. We will post changes here and update the date above; important changes will be announced in the app or by email. Continuing to use the Service after changes take effect means you accept them.

17. General

These Terms and the Privacy Policy are the whole agreement between you and AndresAI about the Service. If any part is found unenforceable, the rest still applies. Our not enforcing a right is not a waiver. You may not transfer these Terms; we may transfer them as part of a business change. If translated, the English version controls.
